Terms of Use
Article 1 (Purpose)
The purpose of these terms and conditions is to define the rights, obligations, and responsibilities of IOCEAN (the e-commerce business operator) and the users in the use of the internet-related services (hereinafter referred to as "services") provided by Crystal Prompter (hereinafter referred to as "the mall").
Note: These terms and conditions also apply to electronic commerce conducted via PC communications, wireless devices, etc., as long as they do not conflict with the nature of such transactions.
Article 2 (Definitions)

"Mall" refers to a virtual marketplace set up by IOCEAN to provide goods or services (hereinafter referred to as "goods, etc.") to users via computers or other information communication devices. It also refers to the business operator managing the cyber-mall.

"User" refers to any individual who accesses the mall and receives the services provided by the mall, in accordance with these terms and conditions, whether as a member or a non-member.

"Member" refers to a user who has registered as a member of the mall and can continuously use the services provided by the mall.
-
"Non-member" refers to a user who utilizes the services provided by the mall without registering as a member.
Article 3 (Specification, Explanation, and Amendment of the Terms)

The mall will post the content of these terms, along with the business name, representative's name, business location (including the address for handling consumer complaints), phone number, fax number, email address, business registration number, e-commerce registration number, and the privacy officer's information, on the initial service screen of Crystal Prompter so that users can easily access them. However, the full terms can also be made available via a linked screen.

Before a user agrees to these terms, the mall must provide a separate linked screen or popup that highlights important details, such as withdrawal rights, delivery responsibilities, and refund conditions, to ensure the user fully understands them.

The mall may amend these terms within the bounds of the relevant laws, including the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms, the Electronic Documents and Electronic Transactions Basic Act, the Electronic Financial Transactions Act, the Electronic Signatures Act, the Information and Communications Network Act, the Door-to-Door Sales Act, and the Framework Act on Consumers.

If the mall amends these terms, the revised terms, the reason for the changes, and the effective date will be posted on the mall's initial screen for seven days before the changes take effect. If the amendments are unfavorable to users, a minimum 30-day grace period will be provided. The mall must clearly compare the previous and revised terms so that users can easily understand the changes.

Amendments to the terms apply only to contracts made after the amendment date. However, if a user who has already signed a contract wishes to apply the revised terms, they can request this within the amendment announcement period, and the mall may approve it.

Matters not specified in these terms will be governed by the Act on Consumer Protection in Electronic Commerce, the Act on Regulation of Terms, the Fair-Trade Commission's consumer protection guidelines for electronic commerce, and other relevant laws or standard practices.
Article 4 (Provision and Modification of Services)

The mall performs the following tasks:

Providing information about goods or services and concluding purchase contracts.

Delivering goods or services for which a purchase contract has been concluded.

Other tasks are determined by the mall.

In cases of stock shortages or changes in technical specifications of goods or services, the mall may modify the content of goods or services to be provided under future contracts. In such cases, the modified content and delivery date will be immediately posted in the same location where the current goods or services are displayed.

If the mall needs to change the content of the service agreed upon with the user due to stock shortages or changes in technical specifications, it will notify the user immediately at the address provided by the user.

In such cases, the mall will compensate the user for any damage caused. However, the mall is not liable if it proves there was no intentional misconduct or negligence.
Article 5 (Service Interruption)

The mall may temporarily suspend the provision of services due to reasons such as maintenance, replacement, failure of information and communication facilities like computers, or disruptions in communication.

The mall will compensate users or third parties for any damage incurred due to the temporary suspension of services mentioned in paragraph 1. However, the mall is not liable if it proves there was no intentional misconduct or negligence.

If the mall is unable to provide services due to reasons such as a business transition, discontinuation, or merger with another company, it will notify users as specified in Article 8 and compensate them according to the conditions initially offered by the mall. If no compensation standards were previously announced, the mall will compensate users by providing cash or items equivalent to the value of any mileage or points accumulated within the mall.
Article 6 (Membership Registration)

Users can apply for membership by filling out the membership information in the form provided by the mall and indicating their agreement with these terms and conditions.

The mall will register users as members unless they fall into one of the following categories:

The applicant has previously lost their membership according to Article 7(3) of these terms. However, if three years have passed since the loss of membership under Article 7(3) and the mall approves their re-registration, they are exempt from this condition.

The registration contains false information, omissions, or errors.
-
The mall deems that registering the user as a member would cause significant technical difficulties.
-
The membership contract is considered established when the mall's approval reaches the user.
-
If there are any changes to the information registered by the member at the time of membership, the member must notify the mall of the changes by updating their information within a reasonable period.
Article 7 (Membership Withdrawal and Loss of Qualification)

A member may request to withdraw from the mall at any time, and the mall will immediately process the membership withdrawal.

If a member falls under any of the following circumstances, the mall may restrict or suspend their membership:

The member provided false information during the application process.
-
The member fails to pay the amount due for goods or other obligations related to the use of the mall by the specified deadline.
-
The member disrupts another person's use of the mall or engages in activities that threaten the order of electronic commerce, such as stealing information.
-
The member engages in illegal or immoral activities that are prohibited by law or these terms while using the mall.
-

If the same behavior is repeated after the membership has been restricted or suspended, or if the issue is not resolved within 30 days, the mall may revoke the member's qualifications.

If the mall revokes a member's qualifications, the mall will delete the member's registration. In this case, the mall will notify the members and give them at least 30 days to provide an explanation before the registration is deleted.
Article 8 (Notifications to Members)

When the mall sends notifications to a member, it may do so via the email address designated by the member in advance through an agreement with the mall.

For notifications to an unspecified number of members, the mall may substitute individual notifications by posting the information on the mall's bulletin board for at least one week. However, for matters that significantly affect the member's personal transactions, the mall will send individual notifications.
Article 9 (Purchase Application)

Users of the mall can apply for purchases using the following or similar methods, and the mall must provide the following information clearly during the purchase process:

Search and selection of goods, etc.

Entry of the recipient's name, address, phone number, email address (or mobile phone number), etc.
-
Confirmation of details related to the terms and conditions, services with limited withdrawal rights, delivery charges, installation fees, and other cost burdens.
-
Indication of agreement to these terms and confirmation or rejection of the details in item 3 (e.g., clicking a checkbox).
-
Submission of the purchase request and confirmation or acceptance of the mall’s response.
-
Selection of payment method.
-
If the mall needs to provide or entrust a third party with the buyer’s personal information, the mall must obtain the buyer’s consent at the time of the actual purchase application. The mall cannot obtain general consent during member registration. At this time, the mall must clearly inform the buyer of the specific personal information to be provided, the recipient, the purpose of use by the recipient, and the duration of retention and use. However, if the entrustment of personal information falls under Article 25(1) of the "Information and Communications Network Act," related laws will apply.

The mall may refuse to accept a purchase application under the following circumstances. However, if a contract is being made with a minor, the mall must inform the minor or their legal guardian that the contract may be canceled if there is no consent from the legal guardian:

If the application contains false information, omissions, or errors.
-
If the minor is attempting to purchase goods or services prohibited under the Youth Protection Act, such as tobacco or alcohol.
-
If the mall determines that accepting the purchase application would cause significant technical difficulties.
-

The contract is considered to be formed when the mall's acceptance reaches the user in the form of a confirmation notice as described in Article 12(1).
-
The mall's acceptance must include confirmation of the user's purchase application, the availability of goods, and information on how to modify or cancel the purchase application.
Article 10 (Formation of Contract)
The payment methods for goods or services purchased from the mall can be made using one of the following methods. The mall cannot charge any additional fees based on the payment method chosen by the user:

Various account transfers, such as phone banking, internet banking, or mail banking.

Payment via prepaid cards, debit cards, or credit cards.
-
Online deposit without a bankbook.
-
Payment using electronic currency.
-
Payment upon receipt.
-
Payment using mileage points or other points provided by the mall.
-
Payment using gift certificates contracted with or recognized by the mall.
-
Other electronic payment methods.
Article 11 (Payment Methods)

When a user submits a purchase application, the mall will send a confirmation notice to the user.
-
Upon receiving the confirmation notice, the user may request a modification or cancellation of the purchase application if there is any discrepancy in the intent. If the request is made before the delivery of the goods, the mall must process it without delay according to the user’s request. However, if payment has already been made, the provisions related to withdrawal of application under Article 15 will apply.
Article 12 (Confirmation Notice, Modification, and Cancellation of Purchase Application)
Article 13 (Supply of Goods, etc.)

Unless otherwise agreed upon between the user and the mall regarding the supply of goods, the mall will take necessary actions, such as custom production and packaging, to ensure delivery of the goods within seven days from the date the user made the purchase. However, if the mall has already received all or part of the payment for the goods, the mall will proceed within three business days from the date of receiving the payment. The mall must also take appropriate measures to allow the user to check the supply process and status of the goods.

The mall must clearly indicate the delivery method, the party responsible for delivery costs for each method, and the delivery period for each method for the goods purchased by the user. If the mall exceeds the agreed delivery period, it must compensate the user for any resulting damage, unless the mall proves that there was no intentional misconduct or negligence.
Article 14 (Refunds)
If the mall is unable to deliver or provide the goods ordered by the user due to reasons such as stock shortages, the mall will notify the user of the reason without delay. If the mall has already received payment for the goods, it will refund the payment within three business days from the date the payment was received or take necessary actions to facilitate the refund.
Article 15 (Withdrawal of Purchase, etc.)

Users who have entered into a purchase contract with the mall for goods may withdraw from the contract within seven days from the date they receive a written document related to the contract, as stipulated by Article 13(2) of the "Act on Consumer Protection in Electronic Commerce." If the delivery of goods occurs after the written document is received, the withdrawal period begins from the day the goods are received or the supply of goods starts. However, if the "Act on Consumer Protection in Electronic Commerce" specifies otherwise for withdrawal, those legal provisions will apply.

Users cannot return or exchange goods if they fall under one of the following conditions:

The goods are damaged or destroyed due to reasons attributable to the user (however, users may withdraw if the packaging was damaged to check the contents).
-
The value of the goods has significantly decreased due to the user’s use or partial consumption.
-
The value of the goods has significantly decreased to the point where resale is difficult due to the passage of time.
-
The goods can be reproduced with the same functionality, and the original packaging has been damaged.
-
In the case of items mentioned in points 2 through 4 of paragraph 2, if the mall did not clearly indicate beforehand that withdrawal of the contract is restricted or failed to provide a sample product, the user’s right to withdraw from the contract will not be restricted.

Despite paragraphs 1 and 2, if the goods are different from what was indicated or advertised or if the contract was executed differently, the user may withdraw from the contract within three months from the date they received the goods or within 30 days from the date they became aware of the issue.
Article 16 (Effects of Withdrawal of Purchase, etc.)

When the mall receives the returned goods from the user, it will refund the payment for the goods within three business days. If the mall delays the refund to the user, it will pay interest for the delay, calculated according to the delay interest rate stipulated in Article 21-2 of the "Enforcement Decree of the Act on Consumer Protection in Electronic Commerce."

When the user has made a payment using a credit card or electronic currency, the mall will promptly request the business handling the payment method to cancel or stop charging the amount for the goods.

In the case of withdrawal of purchase, the user will bear the cost of returning the goods. The mall will not claim any penalties or damages from the user for withdrawal. However, if the withdrawal is due to goods being different from what was advertised or a contract being executed incorrectly, the mall will cover the return shipping costs.

If the user was responsible for the shipping costs when receiving the goods, the mall must clearly indicate who will bear the shipping costs in the event of a withdrawal, so the user can easily understand.
Article 17 (Protection of Personal Information)

The mall collects the minimum amount of personal information necessary to provide services when collecting personal information from users.

The mall does not collect information required to fulfill a purchase contract at the time of member registration. However, if personal verification is needed before fulfilling a purchase contract due to obligations under relevant laws, the mall may collect the minimum specific personal information.

When collecting and using a user's personal information, the mall must inform the user of the purpose and obtain their consent.
-
The mall may not use the collected personal information for purposes other than those stated, nor provide it to third parties. If a new purpose arises or if the personal information needs to be provided to a third party, the mall must notify the user at the stage of use or provision and obtain their consent. Exceptions may be made if required by relevant laws.

When obtaining the user's consent under paragraphs 2 and 3, the mall must clearly state or notify the user in advance of the identity of the personal information manager (including their affiliation, name, phone number, and other contact details), the purpose of collection and use, and details about the provision of information to third parties (the recipient, purpose of provision, and type of information provided) in accordance with Article 22(2) of the "Act on Promotion of Information and Communications Network Utilization and Information Protection." Users may withdraw their consent at any time.

Users may request access to, and correction of their personal information held by the mall at any time, and the mall must promptly take necessary actions. If a user requests a correction of an error, the mall must not use the personal information until the error is corrected.

The mall must limit the number of personnel handling personal information to the minimum required and is responsible for any damages incurred by users due to loss, theft, leakage, unauthorized provision to third parties, or alteration of personal information, including credit card and bank account details.

Once the purpose of collecting or providing personal information has been fulfilled, the mall or the third party who received the information must promptly destroy the personal information.

The mall will not pre-select consent boxes for the collection, use, or provision of personal information. Additionally, if a user refuses to consent to the collection, use, or provision of personal information for non-essential purposes, the mall will clearly specify which services may be limited and will not restrict or refuse to provide services, including membership registration, based on the user's refusal to consent to non-essential data collection.
Article 18 (Obligations of the Mall)

The mall must not engage in any acts prohibited by law or contrary to public order and morals, and it must make every effort to provide goods and services continuously and stably as stipulated in these terms and conditions.

The mall must have a security system in place to protect users' personal information (including credit information) so that users can safely use internet services.

If the mall causes damage to a user by engaging in false or misleading advertising or labeling practices as defined by the "Act on Fair Labeling and Advertising," the mall is responsible for compensating the user for the damage.

The mall must not send unsolicited commercial emails to users for profit purposes without their consent.
Article 19 (Obligations Regarding Member's ID and Password)

Except for cases under Article 17, the responsibility for managing the member's ID and password lies with the member.

Members must not allow third parties to use their ID and password.
-
If a member becomes aware that their ID or password has been stolen or is being used by a third party, they must immediately notify the mall and follow the mall's guidance on the matter.
Article 20 (User Obligations)
Users must not engage in the following actions:

Registering false information during application or modification.
-
Stealing or using another person’s information.
-
Changing any information posted on the mall.
-
Sending or posting information (such as computer programs) is not authorized by the mall.
-
Infringing on the intellectual property rights, including copyrights, of the mall or third parties.
-
Damaging the reputation or interfering with the business of the mall or third parties.
-
Posting or publicly disclosing obscene or violent messages, images, sounds, or any other information that violates public order and morals on the mall.
Article 21 (Relationship Between Linked Malls and Subordinate Malls)

When a higher-level mall and a subordinate mall are connected via a hyperlink (the hyperlink may include text, images, moving images, etc.), the former is referred to as the "linked mall" (website), and the latter as the "subordinate mall" (website).

If the linked mall clearly states on its initial screen or in a popup when the connection occurs that it does not bear any responsibility for transactions made between the user and the subordinate mall for goods provided independently by the subordinate mall, then the linked mall is not responsible for those transactions.
Article 22 (Copyright Ownership and Usage Restrictions)

The copyright and other intellectual property rights for works created by the mall are owned by the mall.

Users must not use the information obtained through the mall, which is subject to the mall's intellectual property rights, for commercial purposes or allow third parties to use it through reproduction, transmission, publication, distribution, broadcasting, or other methods without the mall's prior consent.

If the mall uses the copyright owned by the user according to an agreement, the mall must notify the user.
Article 23 (Dispute Resolution)

The mall will establish and operate a damage compensation mechanism to reflect and address legitimate opinions or complaints raised by users and to handle compensation for any damage.

The mall will prioritize the handling of complaints and opinions submitted by users. However, if prompt processing is difficult, the mall will immediately notify the user of the reason and the processing schedule.

In the case of disputes related to electronic commerce between the mall and users, if a user submits a request for damage relief, the matter may be subject to mediation by a dispute resolution agency commissioned by the Fair-Trade Commission or the relevant city or provincial governor.
Article 24 (Jurisdiction and Governing Law)

Any lawsuits related to electronic commerce disputes between the mall and the user will be filed in the court that has jurisdiction over the user’s address at the time of filing. If the user does not have an address, the case will be filed in the court that has jurisdiction over the user’s residence. However, if the user's address or residence is unclear at the time of filing or if the user resides abroad, the case will be filed in a competent court under the Civil Procedure Act.

The laws of the Republic of Korea will apply to any electronic commerce lawsuits between the mall and the user.
